These general terms and conditions govern the seasonal rental, for holiday use only, of the accommodation presented on this website. They apply to every booking made on the website.
The accommodation is offered for rent by:
Mr Jonathan Payet, private individual
9 chemin Saoudin, Bois d'Olives, 97410 Saint-Pierre, La Réunion, France
E-mail: lespergolasdusud974@gmail.com
Telephone: +262 693 80 98 99hereinafter “the lessor”. The person who makes the booking is hereinafter referred to as “the guest”. The guest must be of legal age and have the legal capacity to enter into a contract; the guest stays in the accommodation for the entire rental period.
The rental is granted as temporary leisure accommodation. The guest may under no circumstances establish their main or secondary residence there, nor carry on any professional activity there.
2. The accommodation
The rented property is a furnished two-bedroom accommodation with a private outdoor area and spa, located in La Réunion. It can accommodate a maximum of 4 people.
Furnished tourist accommodation registration number: 0000000000.
The description, amenities and photographs shown on the website are provided in good faith and describe the accommodation as accurately as possible. The exact address and access arrangements are sent to the guest once the booking has been confirmed.
3. Booking and formation of the contract
Bookings are made online on the website. The guest chooses their dates, states the number of occupants, enters their contact details, reads these terms and conditions and accepts them before proceeding to payment.
The contract is formed when the online payment (deposit or full price) is accepted. A confirmation e-mail summarising the stay, the price and the sums paid is then sent to the guest. It is the guest's responsibility to check that the information entered is accurate and to report any error without delay.
The booking is personal. It may not be assigned, nor may the accommodation be sublet, in whole or in part, without the lessor's prior written consent.
4. Price
Prices are stated in euros. The price of the stay is the price displayed at the time of booking; it includes the provision of the accommodation and its amenities for the number of nights and people booked.
The cleaning fee and, where applicable, the tourist tax and any other supplement are specified at the time of booking, before payment, and appear in the summary.
5. Payment terms
When booking, the guest chooses one of the following two options:
Partial payment: online payment of a deposit of 20% of the total price, the balance being paid on arrival;
Full payment: online payment of the full price.
Online payments are made by bank card using the secure payment solution Stripe. The lessor never has access to bank card numbers and does not store them.
The balance is payable in cash on the day of arrival, before the keys are handed over. A receipt is given to the guest. If the balance is not paid on arrival, the lessor may refuse access to the accommodation; the booking is then deemed to have been cancelled by the guest under the conditions set out in Article 13.
6. Security deposit
The lessor may require a security deposit of €500. It takes the form of a card pre-authorisation carried out via Stripe: the amount is held on the guest's card but is not debited.
In the absence of any damage, loss or breach of these terms and conditions, the pre-authorisation is released no later than 7 days after departure. Otherwise, the lessor may charge all or part of the amount, up to the cost of repair, replacement or additional cleaning, on presentation of supporting documents. If the loss exceeds the amount of the security deposit, the guest remains liable for the difference.
7. Arrival and departure
Arrival: from 4 pm.
Departure: no later than 10 am.
The guest informs the lessor of their expected time of arrival. An arrival or departure outside these times is possible only with the lessor's prior consent. In the event of a significant delay or of being prevented from arriving, the guest notifies the lessor as soon as possible.
An inspection report and an inventory may be drawn up on arrival and on departure. The guest has 24 hours after arrival to report any anomaly or defective equipment; after that time, the accommodation is deemed to be as described and in good condition.
8. Length of stay
The minimum length of stay is 3 nights. The rental is entered into for the period fixed at the time of booking. The guest may not claim any right to remain on the premises at the end of the stay. Any extension is subject to the lessor's prior consent and to the availability of the accommodation.
9. Capacity and occupancy
The accommodation is rented for a maximum of 4 people, including children and infants. The number of occupants may not exceed the number stated at the time of booking. If it is exceeded, the lessor may refuse access to the additional persons or terminate the rental, without refund.
10. House rules
Unless the lessor has given prior written consent:
pets are not allowed;
smoking and vaping are prohibited inside the accommodation;
parties, receptions and events are not permitted;
outside visitors not mentioned in the booking are not allowed.
The guest occupies the premises peaceably and ensures that the neighbours are not disturbed, in particular between 10 pm and 7 am. In the event of a serious or repeated breach of these rules, the lessor may terminate the rental early, without refund.
11. Use of the spa
The spa is provided for the exclusive use of the occupants of the accommodation. It is used entirely at the guest's own risk and responsibility, and the guest undertakes to comply with the following instructions:
minors may use the spa only in the presence and under the constant supervision of an adult; children must never be left alone near it;
shower before each use; do not pour any soap, oil, foam or other product into the water;
do not bring glass or sharp objects into the spa or its immediate vicinity;
do not use the spa after consuming alcohol or medication that impairs alertness; its use is not recommended for pregnant women or for people with heart or circulatory conditions, unless medically advised otherwise;
do not change the settings of the unit or handle the water-treatment products;
put the cover back in place after each use;
use the spa with due regard for the peace and quiet of the neighbours.
The lessor may temporarily suspend access to the spa for reasons of safety, maintenance or breakdown. A brief unavailability beyond the lessor's control does not give rise to any right to compensation. Any damage caused to the spa by improper use is borne by the guest.
12. Guest's obligations
The guest uses the accommodation, furniture and equipment with care and in accordance with their intended purpose. In particular, the guest undertakes to:
report without delay any damage, breakdown or incident occurring during the stay;
not move furniture out of the accommodation or alter the installations;
close doors and windows when absent and keep the premises secure;
return the accommodation tidy and in good usable condition, with dishes washed and rubbish removed, the cleaning fee covering a normal end-of-stay clean;
return all keys and means of access handed over on arrival.
The guest is liable for any damage and loss occurring during the stay, whether caused by the guest or by the persons accompanying them. The lessor or the lessor's representative may enter the accommodation, after informing the guest, for any urgent repair or any work necessary for safety.
13. Cancellation by the guest
Any cancellation must be notified to the lessor in writing, by e-mail. The date on which this notification is received determines the applicable conditions:
Date of cancellation
Consequences
More than 30 days before the arrival date
The 20% deposit is retained by the lessor. If the guest has paid the full price, the portion exceeding the deposit is refunded to the guest.
30 days or fewer before the arrival date
The full price of the stay is due. The sums paid are retained by the lessor and any outstanding balance remains payable.
In the event of a no-show, late arrival or early departure, no refund is due. The guest is advised to take out cancellation insurance.
14. Cancellation by the lessor
If the lessor is obliged to cancel the booking before the start of the stay, the lessor informs the guest as soon as possible and refunds all sums paid, within a maximum of 14 days.
15. No right of withdrawal
The booking relates to an accommodation service provided on a specific date or for a specific period. It is therefore not subject to a right of withdrawal: every confirmed booking is firm, and only the cancellation conditions set out in Article 13 apply.
16. Liability and insurance
The guest is liable for any damage they cause to the accommodation, to its contents and to third parties during the stay. It is the guest's responsibility to check that their insurance covers their civil liability for holiday rentals (holiday-rental liability cover) and, failing that, to take out suitable insurance.
The lessor cannot be held liable for theft, loss or damage affecting the guest's personal belongings, nor for temporary interruptions to services beyond the lessor's control (water, electricity, internet connection, works carried out by third parties). Nothing in these terms and conditions limits any liability that cannot be excluded by law.
17. Force majeure
Neither party is liable for failure to perform its obligations where that failure results from an event of force majeure within the meaning of the law, in particular a cyclone, a weather alert requiring people to stay indoors, a volcanic eruption, a natural disaster or a decision by the authorities making the stay impossible. In such a case, the parties will confer in order to agree on a postponement of the stay; failing agreement, the sums paid for the nights not spent are refunded.
18. Personal data
The personal data collected at the time of booking are processed by the lessor for the purpose of managing the stay, under the conditions described in the Privacy Statement available on this website.
19. Governing law and disputes
These terms and conditions are governed by French law. Should any difficulty arise, the guest is invited to contact the lessor first in order to seek an amicable solution.
Failing agreement, the dispute falls within the jurisdiction of the competent courts of Saint-Pierre (La Réunion), subject to the mandatory statutory provisions that protect consumers, in particular those of the consumer's country of residence.
These terms and conditions are available in several languages. In the event of any discrepancy between the versions, the French version prevails.
